1. Introduction

Welcome to Hyper AI. These Terms and Conditions govern your access to and use of our services, which are primarily provided through our Telegram bot (@hyperai_xbot), and our website. By using our services, you agree to comply with and be legally bound by these terms. If you do not agree, please do not use our services.

2. Services

  • Hyper AI provides access to advanced artificial intelligence models (e.g., Veo 3, GPT, diffusion models) via Telegram.
  • Users may generate video, image, or text content using our AI tools, subject to daily generation limits and subscription plans.
  • All AI generation requests are processed through the Telegram bot only. Web access is limited to policy, billing, and account information.

3. Account Registration and Security

  • Users must have an active Telegram account to access services.
  • By interacting with our bot, you authorize us to collect your Telegram ID and public profile information.
  • You are responsible for all activity conducted through your Telegram account and should keep your Telegram account secure.

4. Subscription Plans and Payments

  • Hyper AI offers subscription plans with varying limits (e.g., 10 or 50 videos per day).
  • All payments are made via supported gateways (Razorpay, Stripe, etc.).
  • Subscription is activated upon successful payment and is valid for 30 days unless otherwise stated.
  • One video generation is valued at $6 USD. If the user consumes content exceeding the market value of their plan, Hyper AI may suspend the account without refund.

5. Refund Policy

Refunds are only allowed if:

  • No generation has been done and the refund request is made within 24 hours.
  • Once any video/image/text is generated, no refund is applicable.

6. Acceptable Use Policy

You agree NOT to use our service to:

  • Generate illegal, pornographic, violent, harmful, or misleading content.
  • Exploit the AI models in a way that exceeds fair use (e.g., automated abuse, reselling without a reseller plan).
  • Reverse-engineer, scrape, or interfere with our systems or Telegram bot infrastructure.

7. Fair Usage and Abuse Policy

  • We offer high-value models at a discounted rate. If your usage exceeds the market value of your subscription (e.g., 6 videos at $6 = $36, but you paid ₹2499), your account may be suspended.
  • We may disable, restrict, or permanently ban accounts without prior notice in case of abuse.

8. Intellectual Property

  • All content, branding, and technology used on our platform is the intellectual property of Hyper AI or its licensors.
  • Generated content may be used for personal or commercial use, but users are solely responsible for legal and ethical use.
  • We do not guarantee copyright ownership of AI-generated media due to current global AI copyright laws.

9. Service Availability

We strive for 99% uptime, but we do not guarantee uninterrupted access. We may conduct maintenance, update models, or face downtimes without prior notice.

If the platform is discontinued, and a user has already used content exceeding the subscription value, no refund will be given.

10. Limitation of Liability

  • Hyper AI shall not be liable for any indirect, incidental, special, or consequential damages resulting from your use or inability to use our services.
  • In no case shall our liability exceed the amount paid by you for the current billing period.

11. Termination

  • We reserve the right to terminate your access without notice if you violate these terms.
  • Users may stop using the bot at any time; however, no refund will be issued unless eligible under the refund policy.

12. User Rights & Dispute Resolution

  • You may request access or deletion of your data by contacting support@hyperai.in.
  • For disputes, we encourage friendly resolution first. If unresolved, jurisdiction will be under the courts of Delhi, India.

13. Changes to Terms

We may update these Terms and Conditions from time to time. Changes will take effect immediately upon posting. Continued use of the service implies your acceptance of the revised terms.
